These terms apply to your use of Kitsuen (“the Service”), operated by [Operator name] (“we”, “us”). By using the Service you agree to them. If you do not agree, please do not use the Service.

1. What the Service is

  • Kitsuen is a free guide for finding smoking areas in Osaka and understanding local smoking rules. It provides information only.
  • Smoking-area information comes from public sources, our own surveys and reports from users. It may be wrong, incomplete or out of date. A spot shown on the map may have closed, moved or changed its rules.
  • Always follow local laws, ordinances and the signs and staff instructions on site. If the signs say smoking is not allowed, do not smoke there.
  • The rules guide is a summary based on the listed sources and the date shown. It is not legal advice.
  • The Service does not sell or advertise tobacco products and does not show product names, brands or product images.

2. Who can use the Service

The Service is for people of legal smoking age (20 or older in Japan). If you are under 20, please do not use it.

3. No accounts

The Service has no accounts. When you send something, your browser receives a device token that links your contributions to your browser, as explained in the Privacy Policy. If you clear your browser data, the link is lost and cannot be restored.

4. Rules for reports and notes

When you send reports, suggest edits or report problems, you must not:

  • Send reports you know are false, or report places you have not checked.
  • Include personal information about yourself or anyone else (names, contact details, photos of people, licence plates, etc.).
  • Post offensive, discriminatory, harassing, sexual or illegal content, or content that infringes others’ rights.
  • Advertise or promote products, shops or services, including tobacco products.
  • Send spam, use bots, scripts or other automated means, get around rate limits, or use multiple devices to manipulate information.
  • Interfere with the Service, its servers or other users, or try to access data you are not allowed to access.
  • Do anything else that breaks the law or these terms.

5. Your contributions

You keep any rights you have in what you send. You grant us a worldwide, royalty-free, non-exclusive, perpetual and irrevocable license to use, store, copy, translate (including by machine translation), edit, adapt, publish and display your contributions, and to let our service providers do so on our behalf, for operating, improving and promoting the Service. You agree not to assert moral rights against us or those we authorise for these uses.

You confirm that you have the right to send your contributions. We may edit (for example correct a location note), hide or remove contributions at any time.

6. Moderation

We may review contributions and problem reports, reject edit suggestions, hide spots, ignore reports in reliability calculations, and disable devices that break these terms, without notice. We are not obliged to monitor all content.

7. Third-party services and links

The Service uses third-party services (such as map data and push notifications) and links to external sites, including external map apps for directions. Those are governed by their own terms, and we are not responsible for them.

8. Disclaimer

The Service is provided “as is”. We do not guarantee that the information is accurate, complete or current, that a spot exists or is open, or that the Service will always be available or free of errors. You are responsible for checking the situation on site and for following local rules, including any fines for smoking in prohibited places.

9. Limitation of liability

To the extent permitted by law, we are not liable for damages arising from your use of, or inability to use, the Service, except where caused by our intent or gross negligence.

If Japan’s Consumer Contract Act or another law that protects consumers applies and does not allow this exclusion, we are liable only as that law requires. In that case, for damages caused by our ordinary negligence, we are liable only for ordinary and direct damages actually incurred, and not for special damages or lost profits.

10. Changes and termination

We may change, suspend or end all or part of the Service at any time. You may stop using the Service at any time.

We may change these terms when needed, as permitted by law. We will post the new terms and their effective date in the Service in advance. If you continue to use the Service after the effective date, the new terms apply.

11. Governing law and jurisdiction

These terms are governed by the laws of Japan. The [court] has exclusive jurisdiction in the first instance over any dispute about the Service, unless a law that protects consumers requires otherwise.
